They towed away my parts car....
Question:
I had a 280zxt with the motor pulled but the tranny still intact. Inside there was an ArizonaZcar AL Radiator, Triple Weber Carbs w/Cannon manifold, Stock 280zxt Radiator, a cheap stereo, a speedo cable I was going to sell, an oil temp gauge I was going to use, and it was sitting on an good set of swastika wheels... Im gunna goto the tow yard today and get all my stuff out from inside the car, but I lose everything else like the wheels, tranny, gauge, and speedo cable unless I pay for them towing it away from the house, then storage for a day, then towing it back.... Becuase my property manager is a jerk. It was parked out of the way, and all cleaned up. If you live in an apartment building, very likely the condition of "parking spaces/carport shall be for passenger automobiles in running condition only, and used for parking purposes exclusively, not for washing or repair of such vehicles" is in your lease. I agree that the manager could have at least give you a three day warning to get rid of the part car before having it towed. You must have annoyed/angered him in some way. Where I live, towing is about $45 bucks, it's the storage fee that the towing company make their money on (range from $125-$250 per day). I had a land lady that was like that. She hated that I worked on my Z in my front yard, and threatened to have it towed if it ever stayed in the same place for more than a week. Find a loop hole in the contract, contact a lawyer and talk to him about it, then give the manager the lawyers card and ask him to return the car at no cost to you. You can go get the car if you have ownership, a way to go get it & a place to keep it. The land lord has the authority to have non-running, unlicensed cars towed from his property but that doesn't affect ownership. You'll have to cover the tow bill & storage charge. The tow drivers in Chicago kept a shot gun with them. When in the office, they were behind a thick glass & had a shot gun. Friend of mine owned a body shop & had his car booted. Yeah, I have the title and yes it had a current regestration. That is that part that made me mad. Im sure I was in some sort of violation, but I was checking it every day and they never even put a warning on it. They also towed my 510 out of my driveway! I am not going to get a lawyer involved, I would surely lose becuase I cant prove that they didnt put a warning on it. Also My landlord would get hell from the property manager, and that just wouldnt be right, he has been really good to me. I went to the tow yard today and got everything I could, which means I lost the tranny, speedo cable, oil gauge, wheels, and cheap stereo. They wouldnt let me take anything that was attatched to the car. Also, I had to pay the tow charges and 1 day of storage fee and a tow charge to a wrecking yard. They said that if I just left it there they would just send me a bill after 45 days for storage and towing, then send me to collections. It all came out to about $240.. what a pain in the ass. You went and paid $ and still didn't get the stuff off of your car? There would be a big ass sticky zone on your windshield or something from the warning sticker. When my DSM fell on my foot and put me in the hospital, it was sitting on it's side sorta cuz the front driver wheel was off and it was resting on the suspension on the ground. After a few weeks they put a big bright orange sticker on it saying if it wasnt fixed it'd be towed. They make really sticky stickers for that situation so you can't easily just snatch it off. This wasnt the local PD that towed it, it was the propertly manager. The notices are little slips of paper that the put under your windsheild wiper that someone can easily take. Also we have had alot of storms lately and they could say it got blown off and its not their fault. They let me take everything that was not attatched to the car. So I got my Nissan Comp Headers, Triple carbs, Canon intake, AL Radiator, Stock Radiator, Some steel braided lines, and some other stuff that was being stored inside the car. I lost the tranny, speedo cable, power antenna, gauges, windsheild washer pump, swastika rims, and a couple of CD's I forgot to get. Its not the worst that could have happened, but its still a big annoyance. By the way, does anyone have a stock '83 oil temp/pressure gauge they want to sell me? get your car back. Cut out all tracable numbers pull your parts drop it on his driveway and let him deal with it. That'll cost him around 70 bux to get rid of it to most places. Technically he can't remove it. He'll have to pay someone to have it legally removed. Just make sure it doesn't look like the car you had at you place. Spray cans, sledge hammer, saw, etc... You get the idea. I knew someone that was forced to deal with getting rid of 3 abandoned vans on their property. Um...is it just me or does this sound like a load of crap what he did. He had a car towed from a resident he rents. Check your residential rights as a renter and then call the police. Pay to get your car back and charge the hell out of him. Hence your private property despite being on his land. Would this not consitute being fraud to act as owner to have it towed, trespassing on private property ( he does have to give you notice of what he intends to do on the property you own/lease/rent ) when you are not present or not? Last of all your car was not towed by anyone. That is simply called theft. Legally I can put my car in your driveway and if you tow it I can land you in court for touching it. You would need a court order if I am not correct to remove someone elses property. If he didn't like it he should have kicked you off the property rather than be a freak and remove your car and break the law. Small Claims Court - in Texas $35 to filre; no lawyers; takes cases up to $5000 - the rule of law is Preponderance of Evidence - the more paperwork you have to show the other guy is wrong , you should be able to win. 6. You should have taken your parts, dude! They snowed you. What you do is pay your fines and fees, push it to the curb, remove what you want from it, then sign the pink slip over to the twoing company. They will sell it---which is what they will do anyway. Did you transfer title to them when you left it on their property? If not, you can STILL be "put to collection" which is a B.S. threat. The NEVER do that! What they do is send you lein notices, and 30 days later they auction the vehicle for fees owed. That's how they make their money. You fell for their lie. Too bad. You could have recovered many parts. But now, all you have is what you got, and the reassuring knowledge that the vehicle is still yours, but you have no idea where it is or how it's being used. Whenever you leave a car, leave the signed title with whoever has it, and get a signed release of liability from them! Well, like I said before, Im sure that I was in some sort of a violation that would allow a legal tow. Im not so much looking for advice, just venting frustration. Yeah, in retrospect, I should have had them tow the car back to my house, or just push it to the curb and striped it then gotten rid of it, but I was just to frustrated with the whole thing at the time, the option never occured to me. As far as my landlord goes, Ive said it before and Ill say it again, he is a great guy. I told him about what the property manager did and told him that I probably was in violation, but I was upset that they never even gave a warning notice. When I was renter scum, I had an a$$hole property manager named bud. Alcoholic old dude named "Bud" had uric acid deposits that needed to be drained all the time---"Popeye's Elbows"... Anyway, I had a parts car there, and it drove him NUTS that I would go out in the middle of the night, and move it a few parking spaces this way or that, or park it on the street. Under a locked car cover. It was LaHabra, and we needed a "parking permit" for street parking, which I paid for on another vehicle, and simply spraypainted the license number and parking permit on the car cover to keep the city from towing it when it was on the street. He NEVER actually saw the car running, occasionally he saw me pushing it from here to there, but when he came up and "demanded" to prove to him it ran I basically told him to "FOAD"--I was "busy" and wasn't going down and firing it up just to make him happy, it was licensed, registered (it wasn't) and besides, it's a PITA to get the lock back on the cover! But under the car cover, nobody knows what's inside. If it's a roller, it becomes very difficult to tow or prove non-operational status if you are even moderately careful. There are ordinances in this area about junk cars. If I wanted to have a parts car, I would need to have plates on it or have a car cover. They will send you a letter asking you to remove it, and if you don't they can take legal action against you.
